INSTRUCTIONS FOR MAINTENANCE AND USE OF FOOTWEAR
WARRANTY CERTIFICATE
DENIS SHOES SRL with registered office at Calea Unirii, No. 20J, Promenadei Street, No. 8, SUCEAVA, 720018, tax code RO 18044107, O.R.C. J33/1331/2005, as seller, provides the warranty for the products purchased by you in accordance with the provisions of the Consumer Protection Law of the Republic of Bulgaria.
Please keep and present the tax receipt, instructions and warranty coupon received upon purchase for any complaints regarding the non-conformity of the product.
For the provision of the warranty, please refer to the instructions for use, cleaning and maintenance of the purchased products.
I. Guarantee of conformity
The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods and which is established within two years of that date. In the event of lack of conformity, the consumer is entitled to (i) have the goods brought into conformity, (ii) to benefit from a proportional price reduction or (iii) to have the contract terminated, under the conditions provided for in the CPA.
In order to have the goods brought into conformity, the consumer may choose between repair and replacement, unless the chosen remedy would be impossible or, compared to the other remedy available, would impose costs on the seller that would be disproportionate, taking into account all the circumstances.
The seller may refuse to bring the goods into conformity if repair or replacement would be impossible or would impose costs on him that would be disproportionate, taking into account all the circumstances.
The consumer is entitled either to a proportionate reduction of the price or to have the sales contract terminated in any of the following cases: (i) the seller has not carried out the repair or replacement or, as the case may be, has not carried out the repair or replacement in accordance with the provisions, or the seller has refused to bring the goods into conformity; (ii) a lack of conformity has been established despite the seller's efforts to remedy it; (iii) the lack of conformity is of such serious importance as to justify a reduction of the price or the right to immediate termination of the sales contract; (iv) the seller has declared that he will not bring the goods into conformity within a reasonable time or without significant inconvenience to the consumer, or this is clear from the circumstances of the case.
The consumer is not entitled to have the contract terminated if the lack of conformity is minor.
Consumers may choose a specific remedy if the lack of conformity of the goods is established shortly after delivery, without exceeding 14 calendar days.
Repairs or replacement shall be carried out subject to the following conditions: (i) free of charge; (ii) within a reasonable period, which may not exceed 15 calendar days from the moment the seller was informed by the consumer of the lack of conformity, and which is established by mutual agreement, in writing, between the seller and the consumer, taking into account the nature and complexity of the goods, the nature and seriousness of the lack of conformity and the effort required to carry out the repair or replacement; (iii) without significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which the consumer requested the goods in question.
If the lack of conformity is to be remedied by repair or replacement of the goods, the consumer is obliged to deliver the goods to the seller, cleaned inside and out. The seller accepts the replaced goods at his own expense.
If the lack of conformity is remedied by repair, the two-year period provided for above shall be extended by the time the goods are out of use, from the moment the seller became aware of the lack of conformity until the moment the goods are actually handed over in a state of normal use to the consumer.
If the lack of conformity is remedied by replacement, for goods replacing the non-conforming goods, the two-year period provided for by law shall start to run from the date of replacement.
The price reduction shall be proportional to the reduction in the value of the goods received by the consumer compared to the value that the goods would have had if they were in conformity.
The consumer shall exercise his right to obtain termination of the sales contract by means of a declaration to the seller expressing his decision to obtain termination of the sales contract.
The guarantee shall become inapplicable and DENIS SHOES S.R.L. is not responsible for defects that may occur due to: (i) cleaning/maintenance process that is not in accordance with the specific instructions for each product listed in this coupon; (ii) storage or use of products in humid conditions; (iii) discoloration due to exposure to sunlight or other strong heat sources; (iv) intentional or negligent damage; (v) repairs or modifications made by unauthorized persons; (vi) normal wear and tear of the product; (vii) use in inappropriate, incorrect conditions by users,
